MIMOV App – Family App

1. Purpose
These Terms and Conditions govern access to and use of the MIMOV mobile Family app (hereinafter, the “App”), which is designed to enable family members, carers or authorised persons to view certain information from telecare devices that have been previously authorised and linked by the telecare service provider.
Use of the App implies full acceptance of these Terms and Conditions, as well as the Privacy Policy.
2. App Ownership

(hereinafter, “the Owner”).
3. Purpose of the application
The app allows family members, carers or authorised individuals to view the information generated by one or more MIMOV devices linked to an end user.
Among other features, the app allows you to:
- Pair authorised devices.
- Check the device status.
- View the last recorded location.
- View the location history.
Access biometric - information in supported devices.
- View configured reminders.
- Get directions to the last recorded location.
- Manage the user’s profile.
- Unpair previously authorised devices.
- The availability of these features will depend on the model of the paired device and telecare service provider settings.
4. Non-medical nature of the service
MIMOV Family App and the linked devices are intended solely for care, information and support in relation to the telecare service, enabling family members, carers or authorised persons to view certain information from the linked device, in accordance with the terms configured by the service provider.
The App and linked devices are not classified as a medical device, healthcare product or tool for the diagnosis, prevention, clinical monitoring, treatment or medical management of diseases, injuries, disabilities or physiological or pathological conditions. The information provided via the App does not, under any circumstances, replace the assessment, diagnosis, monitoring, treatment, care or supervision provided by healthcare professionals.
The data, notifications, physiological parameters, locations or alerts displayed by the App are for guidance and information purposes only and may be affected by technical or operational factors, including, but not limited to, network coverage, connectivity, device battery life, device permissions, service settings, correct use of the device, GPS accuracy or the availability of third-party systems.
Accordingly, the App must not be used as the sole means of detecting, managing or responding to medical emergencies, life-threatening situations or situations requiring immediate assistance. In the event of an emergency, the relevant emergency services must be contacted directly.
5. Device compatibility
The App is compatible with the following devices:

Allows you to view:
GPS location history.
Heart rate.
Number of steps.
MIMOV Watch 4.3
Allows you to view:
GPS location history.
Heart rate.
Blood pressure.
Blood oxygen saturation (SpO₂).
Number of steps.
Reminders set on the device.
The Owner may include new models or features in future versions of the Application.
6. Pairing of devices
In order to access device information, you need to:
have a user account;
request device pairing using its IMEI or QR code;
have the request validated by the service provider.
Linking is not immediate and may require verification of the requestor’s identity and their authorisation to access device information.
The telecare service provider may reject any request where there are doubts regarding the requestor’s identity or their authorisation to access the data.
7. Information displayed
Depending on the device, the App may display:
Connection status.
Battery level.
Date and time of the last communication.
Last recorded location.
Journey history.
Available biometric data.
Configured reminders.
Service provider information.
The information displayed is for guidance only and will depend on the features of the device installed.
8. Geolocation
The App allows you to check the location of the telecare device.
The user expressly acknowledges that:
the information corresponds to the position recorded by the device;
accuracy will depend on GPS coverage and environmental conditions;
there may be delays in updating the information;
the location may be temporarily unavailable.
The App does not guarantee continuous or permanent tracking.
9. Biometric data
Some devices allow you to view certain biometric parameters, such as:
heart rate;
blood pressure;
oxygen saturation;
number of steps.
These values are for guidance only.
Under no circumstances do they constitute a medical diagnosis or replace the assessment carried out by healthcare professionals.
The Owner shall not be liable for any medical decisions taken solely on the basis of the information displayed by the App.
10. Reminders
Where the device supports this feature, the App will allow you to view your configured reminders.
The presence of a reminder in the App does not guarantee that the device user has received, responded to or acted on that reminder.
11. Authorised use
The user undertakes to use the App exclusively for:
monitoring devices for which they have authorisation;
viewing service information;
using the App in accordance with current legislation.
The following is prohibited:
attempting to access third-party devices;
sharing access credentials;
tampering with the App;
using the information for unlawful purposes.
12. Authorisation to access information
The user declares, on their own responsibility, that they have sufficient authorisation to access the information on the linked device.
Such authorisation may come from:
the device user themselves;
their legal representative;
the service provider.
The service provider may request supporting documentation where necessary.
13. Service availability
The App requires:
an internet connection;
an operative mobile device;
availability of third-party services (Google, Apple, maps, mobile networks, etc.).
The Owner does not guarantee the uninterrupted availability of the service.
Interruptions may occur due to:
maintenance;
technical issues;
lack of coverage;
operator faults;
system updates.
14. Security
The user must:
keep their login details secure;
log out of shared devices;
report any unauthorised access immediately.
The App may allow biometric authentication in supported mobile devices.
15. Data protection
Personal data will be processed in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and the App’s Privacy Policy.
The following data, amongst others, may be processed:
identification data;
contact details;
location data;
biometric information generated by certain devices;
technical information relating to the service.
The processing will be carried out solely for the purpose of providing the telecare service and granting access to authorised persons.
16. Intellectual property
All rights to the App, its design, logos, images, software and documentation are held by the Provider or its licensors.
Reproduction or distribution without express authorisation is prohibited.
17. Disclaimer
The App is a tool designed to assist in the monitoring of MIMOV device users.
It is not a substitute for:
healthcare;
personal supervision;
emergency services.
The Owner shall not be liable for any damage arising from:
misuse of the App;
incorrect information provided by the user;
communication disruptions;
malfunctioning GPS;
loss of mobile coverage;
third-party service failure.
18. Amendments
The Owner may amend these Terms and Conditions whenever necessary for legal or technical reasons, or to improve the service.
Where the amendments are substantial, the user will be informed and must accept them in order to continue using the App.
19. Governing law
These Terms and Conditions shall be governed by Spanish law.
Any disputes shall be submitted to the courts and tribunals having jurisdiction in accordance with current legislation.
20. Acceptance
By ticking the box “I accept the Terms and Conditions” and accessing the App, the user declares:
to have read this document in full;
that they understand its content;
to accept all its terms and conditions;
to have authorisation to access information from linked devices;
to undertake to use the App responsibly and in accordance with applicable legislation.
